Data processing agreement – draft

1. Parties/scope

Controller: identified legal team entity, authorised instructors/privacy contact. Protected relay/transient buffers/assignment/provision of instructed media/team/viewer data during service/closure/deletion; separate provider own purposes.
2. Data/people
Video/audio/team-car-driver/planning-branding/viewer-email-role/technical metadata; drivers/members/viewers/people in field. No planned sensitive categories without assessment. No archive.
3. Instructions/confidentiality
Documented instructions including recipients/transfers; advance notice of mandatory contrary law where allowed. Authorised portal/text instructors; report apparently unlawful instructions before action. Confidential personnel/no advertising/reuse.
4. TOM
Confirm connections/roles/team boundaries/hash-revocation/secrets/limited access/capacity-transactions/logs-updates/backups-restore. No operator-excluding encryption. Confirm periods/evidence; changes must not lower protection.
5. Subprocessors
Confirm actual Hostinger entity/services/locations/subprocessors/transfer grounds and webgo instructed email. Google/PayPal not automatically media processors. General authorisation: notify before changes/permit privacy objections/pass equivalent duties/remain responsible. Instructions and Chapter V transfers, no unverified EU-only promise.
6. Support/audit
Assist rights/security/impact assessment/consultation; refer instructed requests, no contrary reply. Notify breaches promptly after awareness with scope/consequences/actions and supplements. Provide compliance evidence, support audit/inspection coordinated to protect others; certificates do not exclude rights.
7. End/acceptance
Return/delete including copies at choice after end unless legal retention; protect/erase remnants after duty. Backup/restore must respect erasure. Confirm party-instructions, specification, subprocessors/transfers, TOM, return/deletion and written/electronic acceptance. info@stintcast.com.
